Super speeder leading to a DUI

According to appen media, on New Year’s Day, January 1, 2025, a man from Buford was stopped on Georgia 400 for speeding at 100 miles per hour. The deputies who initiated the stop also charged him with DUI. Several code sections cover these charges, including DUI, codified under O.C.G.A. 40-6-391, and Speeding, under O.C.G.A. 40-6-181.

Officers only need one reason to establish reasonable articulable suspicion to justify stopping your vehicle. The speeding charge of 100 Miles per hour falls under O.C.G.A. § 40-6-181 and states that the “limits specified in this code section or established as authorized in this article shall be the maximum lawful vehicle speeds.” Some drivers don’t realize that if you are traveling more than 85 miles per hour on a highway or over 70 miles per hour on a nonhighway, you are considered a super speeder.  Super speeder violations come with issues of an additional license suspension if you enter a plea to them along with points on your license. Couple with these charges that the police are arresting the driver for being impaired (or intoxicated), now you have to add all the complications of DUI (O.C.G.A. § 40-6-391) and its investigation into the mix. This means that there will be enhancements to the sentencing guidelines if that driver should be found guilty of the DUI.

It doesn’t matter where you find yourself in Georgia. Almost all police forces are ramping up their investigations of DUI, including Johns Creek Police, Alpharetta Police, Milton Police, DeKalb County Police, City of Decatur Police, Atlanta, Police Gwinnett County Police, and so on. Many traffic investigation “tools” allow the police to stop a vehicle for any “legal” reason, and their investigation can lead to a DUI if they suspect the driver has been drinking or using drugs.

In addition, due to the Governor’s Office of Highway Safety teaming up with various organizations, including the HEAT and TEAM division of local counties, the cops have been cracking down on impaired driving since the pandemic.
