Many people don’t realize that the crime of an Aggravated Assault can happen to anyone. Certain circumstances, however, can make the charges become greater than just Aggravated Assault. Aggravated Assault is defined in O.C.G.A. 16-5-21 and involves someone who intends to assault with intent to murder, rape or rob, either with a deadly weapon, or with an object or device or without legal justification shoots a firearm at another.
However, where the assault involves a particular type of person, such as a public person, an elderly person, a spouse or various other small alterations which would increase the jail or prison exposure from the charge. Assault by itself is a serious charge and can carry 1-20 years, but when the extra items come into play, they can create jail exposure of anywhere from a 5-20 year minimum sentence.
